By visiting https://forms.sonymusicfans.com/whitney-houston-bodyguard25/ and uploading your YouTube® or Instagram video, or by posting your Instagram video with the two hashtags #TheBodyguard25 and #WhitneyFanVideos (hereinafter, the “Submission Materials”), you represent and warrant that: (A) all contents of the Submission Materials are wholly original, have been created entirely by you, have not been taken in whole or in part from any source other than you and do not incorporate or include anything that is owned by any third party or would require the consent of any third party; (B) you own and/or control 100% of all right, title and interest in and to the Submission Materials, as well as all elements contained therein; (C) the Submission Materials do not and shall not violate any law or the copyright, trademark, publicity right, privacy right, or any other right of any third party; (D) the Submission Materials, or any part thereof, have not been commercially released; and (E) you have the written consent, release and/or permission of each and every participant in the Submission Materials to participate in the Submission Materials as contemplated herein – if you (or any participant) are under the age of majority in your state or province of residence, you have the written permission of such individual’s parent or legal guardian to participate in the Submission Materials as contemplated herein; (F) you and any individual(s) participating and/or appearing in the Submission Materials are at least fifteen (15) years of age as of the date of submission; (G) you and any individual(s) participating and/or appearing in the Submission Materials are a legal resident of the fifty (50) United States and the District of Columbia (excluding territories and possessions), or a legal resident of Australia, Canada or France; and (H) you agree that the Submission Materials shall be a “work made for hire,” with all rights therein, including, without limitation, the exclusive copyright, being the property of Sony Music Entertainment (“SME”). In the event the Submission Materials are considered not to be a “work made for hire,” you irrevocably assign to SME all right, title, and interest in your Submission Materials (including, without limitation, the copyright) in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all uses thereof, including, without limitation, for use in or in connection with a video celebrating the twenty-fifth anniversary of the film The Bodyguard (the “Video”) featuring Whitney Houston (the “Artist”) and the film’s corresponding soundtrack (the “Soundtrack”).
The Submission Materials may not contain references which are obscene, crude, vulgar or defamatory; depict or contain references to excessive consumption of alcoholic beverages; contain gang identification, references to commercial products, license plate numbers, phone numbers, personal addresses (physical or email), Website URLs, derogatory characterizations of any ethnic, racial, sexual or religious groups; contain references to illegal or inappropriate activity, behavior or conduct; or contain any other references that could be considered inappropriate, unsuitable or offensive, as determined by SME, in its sole discretion.
By providing Submission Materials in connection herewith, you grant to SME and its affiliated companies the right, except where prohibited by law, to use your Submission Materials, or any portion thereof, as part of or in connection with the Video, Artist or Soundtrack without compensation to you unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of the Submission Materials. You hereby release SME from, and shall neither sue nor bring any proceeding against any such parties for, any liability, loss, demands, claims or causes of action, whether now known or unknown, for defamation, invasion or other violations of rights to privacy, publicity or personality, or any similar matter or based upon or relating to the use of my Submission Materials, and for any loss, damage, injury, including death, that you may sustain. You irrevocably waive in favor of SME any and all moral rights that you may have with respect to the Submission Materials. The rights granted under this paragraph shall extend to SME and its affiliated companies and agents with respect to all participants in the Submission Materials. The Submission Materials to be used in or in connection with the Video, Artist or Soundtrack will be selected by SME in its sole discretion. SME is under no obligation to use any of the Submission Materials for any other purpose. By providing the Submission Materials in connection herewith, you agree that you will complete and execute any and all documentation provided to you (if any), as-is, by SME in connection with SME’s use of the Submission Materials.
You hereby represent and warrant that: (a) you and any individual(s) participating and/or appearing in the Submission Materials are: (i) legal resident(s) of the fifty (50) United States or the District of Columbia (excluding territories and possessions); and (ii) at least fifteen (15) years of age as of the date of submission; and (b) you (or your parent/legal guardian if you are a minor) have read and agree to the foregoing and are fully familiar with its contents.
By continuing, you (or your parent/legal guardian if you are a minor) agree to be bound by the decisions of SME and to comply with all federal, state, and local laws and regulations.

En consultant le site https://forms.sonymusicfans.com/whitney-houston-bodyguard25/ et en postant votre vidéo Youtube ou Instagram, ou en publiant votre vidéo Instagram avec les deux hashtags #TheBodyguard25 et #WhitneyFanVideos (ci-après « la Vidéo »), vous déclarez et garantissez que :
(A) Le contenu de la vidéo est une création totalement originale, personnelle, n’est pas issue, en tout ou partie, d’une source dont vous n’êtes pas l’auteur, et n’incorpore, ni ne comporte d’éléments appartenant à un tiers ou qui requiert le consentement d’un tiers ;
(B) Vous êtes l’unique titulaire et/ou vous possédez la totalité des droits, titres, et intérêts sur la Vidéo, ainsi que sur tous les éléments qu’elle contient,
(C) La Vidéo ne viole aucune loi ou droits d’auteur, marques, droit à l’image, droit à la vie privée ou tous autres droits des tiers ;
(D) La Vidéo, ou toute partie de celle-ci, n’a pas été commercialisée ; et
(E) Vous avez le consentement écrit et l’autorisation de chaque participant de la vidéo, de participer à ladite Vidéo, dans les conditions telles que prévues dans les présentes conditions. Si vous (ou tout autre participant) êtes mineur, vous devez avoir l’autorisation parentale ou légale, rédigée en bonne et due forme et signée par le ou les titulaires de l’autorité parentale, de participer à la Vidéo ;
(F) Vous et toute autre personne participant et/ou apparaissant dans la Vidéo devez avoir au moins quinze (15) ans à la date de publication de la Vidéo ;
(G) Vous et toute autre personne participant et/ou apparaissant dans la Vidéo résidez sur le territoire français, ou êtes un résident légal des cinquante (50) États-Unis et du District de Columbia (à l’exclusion des territoires et possessions), ou un résident légal de l’Australie ou du Canada; et
(H) Vous cédez à Sony Music Entertainment (« SME »), de manière définitive et irrévocable, tous les droits, titres et intérêts sur votre Vidéo (en ce compris, sans limitation, les droits d’auteurs) pour tout moyen de communication, connu ou à connaître, dans le monde entier et pour toute la durée de protection légale du droit d’auteur. Il comprend également le droit d’en faire toutes les utilisations qui en découlent, y compris, sans limitation, à l’occasion de la vidéo célébrant le vingt-cinquième anniversaire du film The Bodyguard (la « Vidéo du Film ») mettant en scène Whitney Houston (« l’Artiste ») et la bande-son dudit film (la « Bande-son »).
La Vidéo ne doit contenir aucun élément présentant un caractère obscène, grossier ou diffamatoire ; ni de contenu incitant à une consommation excessive de boissons alcoolisées ; ni de référence à un gang identifié, à des produits commerciaux, à des plaques d’immatriculations de véhicules, à des numéros de téléphone, à des adresses personnelles (postale ou électronique), à des sites internet, à caractère discriminatoire, incitant à la haine, en raison de l’origine ou de l’appartenance ou de la non-appartenance à une ethnie, nation, race, sexe et religion déterminée ; ni contenir de référence à une activité, attitude ou conduite illégale ou inappropriée ; ou encore contenir toute autre référence qui pourrait être considérée inappropriée, inadaptée ou injurieuse, telle que déterminée par SME et ce, à son entière discrétion.
En fournissant la Vidéo telle que décrite dans les présentes, vous concédez à SME et ses sociétés affiliées, le droit d’utiliser votre Vidéo et toute partie de celle-ci, en vue de l’intégrer à la Vidéo du Film, de l’Artiste ou de la Bande-son sans pouvoir requérir aucune compensation à ce titre.
Vous n’avez aucun droit d’approbation, d’indemnisation et de réclamation (en ce compris, sans limitation, des demandes fondées sur une diffamation, une atteinte à la vie privée ou au droit à l’image) découlant de toute utilisation, floutage, altération ou utilisation seule ou combinée à d’autres éléments de la Vidéo.
Par la présente, vous dégagez SME de toute responsabilité et vous ne pouvez ni poursuivre, ni intenter d’action en justice contre toutes les parties présentes, en cas de pertes, dommages, réclamations, litiges, qu’ils soient d’ores et déjà connus ou inconnus, pour diffamation, atteinte ou toutes autres violations du droit à la vie privée, à l’image ou de la personnalité, ou tout enjeu similaire ou fondé ou lié à l’utilisation de la Vidéo.
Les droits accordés en vertu du présent paragraphe s’étendent à SME, ses sociétés affiliées et ses agents vis-à-vis de tous les participants de la Vidéo.
La Vidéo utilisée dans le cadre de la Vidéo du Film, de l’Artiste ou la Bande-son sera sélectionnée par SME, à son entière discrétion. SME n’est en conséquence soumise à aucune obligation d’utiliser la Vidéo.
En fournissant la Vidéo prévue aux présentes, vous acceptez de remplir et de respecter toute la documentation fournie par SME concernant l’utilisation par SME de ladite Vidéo.
Par la présente, vous déclarez et garantissez que :
(a) Vous et toute autre personnes participant et/ou apparaissant dans la Vidéo : (i) résidez sur le territoire français ; (ii) êtes âgés d’au moins quinze (15) ans à la date de publication de la Vidéo ; et
(b) vous (et le ou les titulaires de l’autorité parentale si vous êtes mineur) avez lu et accepté tout ce qui précède et êtes pleinement informé de son contenu.
En continuant, vous (ou le ou les titulaires de l’autorité parentale si vous êtes mineur) acceptez d’être lié par les décisions de SME et de vous conformer à la loi française. La présente opération promotionnelle sera soumise à la loi française.
SME tranchera souverainement tout litige relatif à l’opération promotionnelle et à son règlement.
Il ne sera répondu à aucune demande téléphonique ou écrite concernant l’interprétation ou l’application du présent règlement, les mécanismes ou les modalités de l’opération promotionnelle.
